Acceptance of Terms

By creating an account and using Cut List Maker, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

Description of Service

Cut List Maker provides a web-based tool for optimizing material cutting layouts for woodworking and manufacturing projects. Our service includes:

• Cut list optimization algorithms
• Project storage and management
• Export capabilities for cut lists
• Visualization tools for cutting layouts

User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and current

Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload malicious code or viruses
• Reverse engineer or attempt to extract source code
• Use automated systems to access the service without permission

Data Collection and Analytics

To improve our service and user experience, we collect and analyze usage data:

• We store your project data, including cut lists, panel configurations, and sheet layouts in our secure database

Intellectual Property

Cut List Maker and its original content, features, and functionality are owned by Miller Hardware and Tools and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your project data and cut lists. By using our service, you grant us a limited license to store and process your data solely for the purpose of providing the service to you.

Disclaimer of Warranties

Cut List Maker is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

• The service will be uninterrupted or error-free
• The results obtained from the service will be accurate or reliable
• Any errors in the software will be corrected

You are solely responsible for verifying all measurements and cut lists before use in actual projects.

Limitation of Liability

Miller Hardware and Tools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of or inability to use the service.

Subscription and Payment

Some features may require a paid subscription. By purchasing a subscription:

• You agree to pay all fees associated with your subscription
• Subscriptions automatically renew unless cancelled
• Refunds are handled on a case-by-case basis
• We reserve the right to change pricing with notice

Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will immediately cease.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date.

Cut List Maker Affiliate Program

The following additional terms apply to people who join or participate in the Cut List Maker affiliate program. By using an affiliate link issued through our program to promote Cut List Maker, you agree to these affiliate program terms. We may approve or decline affiliate applications at our discretion. Affiliates must provide accurate account and payout information.

Eligible Purchases and Commission

An affiliate may earn a one-time $5 USD commission when a new referred customer completes their first qualifying purchase of Monthly Pro, Yearly Pro, or Lifetime Pro. Only one commission is available per referred customer. Subscription renewals, later plan changes, and additional purchases by that customer do not earn another commission.

The 3-day pass does not qualify for a commission. If a referred customer buys a 3-day pass and later buys a qualifying Pro plan, the later purchase may qualify for one $5 commission if the referral remains correctly attributed. Free accounts, clicks, signups, abandoned checkouts, and unpaid purchases do not earn commissions.

Referral Attribution

Affiliates must use their assigned tracking links. A purchase qualifies only when our affiliate tracking and payment systems attribute it to the affiliate. Link tracking currently depends on the customer using the same browser and permitting the applicable advertising cookies. Tracking may fail if the customer changes browsers or devices, clears cookies, blocks tracking, or declines advertising cookies. We cannot guarantee credit for purchases that our systems cannot attribute.

Refunds and Invalid Transactions

We may decline or reverse commissions for refunded, disputed, charged-back, fraudulent, duplicate, or otherwise ineligible purchases. If such a commission has already been paid, we may deduct it from future commissions or request repayment.

Affiliate Payouts

Approved commissions are paid on a NET 30 schedule, generally about 30 days after the end of the calendar month in which they were earned, subject to payment processing, accurate payout information, and review of refunds or disputes. Affiliates are responsible for taxes on their earnings and for providing information reasonably needed to process payment.

Affiliate Promotion Rules

Affiliates must describe Cut List Maker, its features, and its pricing accurately. Affiliates must clearly disclose when they may earn a commission from a recommendation. For example: “I may earn a $5 commission if you purchase a qualifying Cut List Maker Pro plan through my link.” This disclosure should appear where people will notice it before or alongside the recommendation.

Affiliates may not refer themselves; create fake accounts, clicks, or purchases; send unsolicited commercial messages; make misleading claims; impersonate Cut List Maker; advertise unauthorized discounts or promo codes; or bid on Cut List Maker’s name, domain, or confusingly similar terms in paid search without written permission. Affiliates must follow applicable laws and the rules of the platforms where they promote us.

Program Changes and Termination

We may change the affiliate program or these affiliate terms prospectively by posting revised terms or notifying affiliates through the program. We may suspend or end participation for violations, suspected fraud, or conduct that could harm customers or Cut List Maker. Ending participation does not cancel valid, approved commissions earned beforehand, but ineligible or reversed commissions remain subject to the rules above.

Cut List Maker may feature affiliate links, sponsored content, or paid partnerships. Any material connection between us and a third-party brand will be disclosed clearly in the relevant content, consistent with the FTC's Endorsement Guides (16 C.F.R. Part 255). Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Miller Hardware and Tools operates, without regard to its conflict of law provisions.
